Minutes of the Arvin Union School District Board of Trustees Special Meeting held on August 4, 2009.

 

The meeting was called to order by Mr. Stoner at 5:31 p.m.

Adoption of the Agenda

No reports from the administration.  At this time, Mr. Stoner announced the opportunity for public comment. 

 

Mr. Jose Garcia, 501 Jess St., Arvin; addressed the board regarding his job reassignment.  He asked the board if any decision had been made to change the reassignments made by the administration.  Mr. Stoner replied the board had received a report from the administration prior to this evening’s meeting.   Mrs. Kavanagh explained that tonight’s meeting was a special board meeting and did not include agenda items regarding the MOT reassignments.  Mrs. Kavanagh told Jose that he needs to contact her if he wished to place an item on the agenda.

 

Mrs. Rubio responded to Mr. Garcia that the board would review the information given to them tonight.

 

Ms. Sylvia Balteria, 925 Lomita Drive, Bakersfield, Sierra Vista Custodian/Driver; explained that in the process of reassignments she was being transferred from Sierra Vista as a driver/custodian to Bear Mountain as a driver/custodian.  She hoped the board would review the recommended transfers and consider the experience and seniority of each employee involved and return to the next board meeting with a decision different that what was recommended to them.

 

Mr. Stoner thanked the audience for their comments and continued with the next order of business.

 

The board went into closed session at 5:44 p.m. to consider and take proposed action on the proposed decision of the Administrative Law Judge in OAH Case #20090600665 (regarding the midsummer certificated services reduction and layoff matter, resolution originally adopted by the board on June 4, 2009).   The board may accept, modify or reject the proposed decision.  Mr. Pete Carton, Attorney from Schools Legal Service, KCSOS, representing Arvin Union School District, joined the board in closed session.

 

The board returned to open session at 6:24 p.m. and the following report was given.  Mr. Stoner announced that after reviewing the hearing findings the board found technical difficulties with the findings of the hearing but agreed with the final results of the hearing from the Administrative Law Judge in OAH Case #20090600665 regarding the midsummer certificated services reduction and layoff matter with the following vote taken. 

 

On motion of Mrs. Tarver, seconded by Mr. De Leon, the board unanimously accepted the proposed decision of the Administrative Law Judge in OAH Case #20090600665.

 

Mr. Stoner confirmed Ms. Michelle Padilla and Shawna Rohatsch will not return as a contracted teacher for the 2009/2010 school year.  However it was noted that both Ms. Padilla and Ms. Rohatsch will be the first-call substitute teachers for the 2009/2010 school year.  Mr. Stoner also confirmed Ms. Rosemarie Borquez, Ms. Maria Duran and Mrs. Vanessa Valtierra will be contracted as teachers for the 2009/2010 school year.
